About Your Petition For Dissolution Of Marriage

As Florida is a no-fault divorce state, neither party needs to prove fault to obtain a divorce. You or your spouse needs only to assert that the marriage is irreconcilably broken. At least one of you must have been a Florida resident for six months prior to the filing of the petition for dissolution of marriage.

Your divorce will be uncontested if you agree on how you will divide assets and share parenting time. In case of disagreements that cannot be resolved, your divorce will be considered contested. In this case, it may be more challenging to reach a conclusion. You may reach a conclusion through negotiations, mediation or trial – the last resort, but a possibility that we are always ready for.

Fighting For The Rights Of Both Parents

Many fathers are not aware of all their rights as a parent. In today’s social environment, however, a mother does not automatically get primary custody of the children. A father’s right to seek custody is given the same weight as that of a mother.

Mothers, on the other hand, sometimes worry that they will lose custody rights because of their lower income.

Thankfully, the family law court places a high priority on preserving parent-child relationships with both parents, whenever possible. Child custody and child support are separate, though related, matters. Child support is calculated with a state-provided formula that takes many factors into account.

Whether you are a mother or father (or a grandparent raising a grandchild), you deserve to have an attorney who will educate you on your rights. We support fathers’ rights and mothers’ rights. The best interests of the child very likely include their nurturing relationship with you. We want to help you protect your parental rights.
